Will The Guardian Be Required To Cover All Of That Person’s Expenses?

A person who becomes Guardian of another individual is not personally responsible for their bills, their debt, or their expenses. What they are responsible for is making sure the individual’s own finances are properly managed, which may include paying off debt with the incapacitated individual’s income or assets.

If it happens to be that the incapacitated person has so much debt that it’s unmanageable, the Guardian can file a bankruptcy proceeding on behalf of the incapacitated individual. This would have zero effect on the Guardian’s credit.

The only time a guardian would be financially liable is if they were found to be abusing their legal power. This is called breach of fiduciary duty. In that situation, the Guardian would have to pay back whatever damage they’ve caused, plus a penalty determined by the court.
